The electronic web shop of Mknives, a BV with registered office in Erps-Kwerps (Belgium), VAT BE 0748.562.955, offers its customers the opportunity to purchase kitchen knives online.
These General Terms and Conditions ("Terms and Conditions") apply to any order placed by a visitor to this website (“Customer”) at the webshop of Mknives BV (www.mknives.eu). Placing an order through the webshop of Mknives BV implies that the customer has consulted these Conditions and explicitly accepts the applicability of these Conditions or has created legitimate confidence that he has accepted the validity, to the exclusion of all other conditions. Article 4: Online purchases

Order procedure

Orders are placed via the 'webshop' page at www.mknives.eu/webshop . After the customer has ordered the desired product (and if applicable the desired quantity of the product), and the customer has clicked on the 'buy now' button, the customer is redirected to the payment page.

The customer can choose between the following payment methods

The purchase is made when the customer receives a confirmation email from mknives.belgium@gmail.com

The items are delivered to the customer's home on the delivery date indicated in the confirmation email.

Mknives BV is entitled to refuse an order (in writing) due to a serious shortcoming of the customer with regard to the order or any other order or agreement in which the customer is involved.

Article 5: Retention of title

The delivered items remain the exclusive property of Mknives BV until full payment has been made by the customer.
However, the risk of loss or damage is transferred to the customer from delivery. The customer undertakes, if necessary, to inform third parties of the retention of title of Mknives BV, for example to anyone who would seize articles that have not yet been fully paid for.


Article 6: Penalties for non-payment

Without prejudice to the exercise of other rights that Mknives BV has, the customer owes interest of 10% per year on the unpaid amount in the event of non-payment or late payment from the date of the default and without notice. In addition, the customer is legally and without notice due a fixed compensation of 10% on the amount concerned, with a minimum of 25 euros per invoice.

Without prejudice to the foregoing, Mknives BV reserves the right to take back items that have not been paid (in full).


Article 7: Delivery

The Delivery of purchased products is provided by 3rd parties (Bpost). A purchase from Mknives BV is delivered to the customer's address for destinations within the European Union within 1 to 8 working days. Mknives BV cannot be held responsible for a later delivery.

Shipping within Belgium is free (0.00 €)

Shipping to the Netherlands and Luxembourg is an additional cost of € 15.00 on top of the purchase price.

Shipping to Germany and France is an additional cost of € 30.00 on top of the purchase price.

Shipping to all other destinations costs 75.00 € on top of the purchase price. Shipping to these destinations takes 1 - 15 days. Mknives BV cannot be held responsible for a later delivery.
Any visible damage and / or qualitative shortcoming of an article or other shortcoming in delivery must be reported immediately.


Article 8: Warranty

a. Legal warranty (only for consumers)

Under the law of September 21, 2004 on the protection of consumers in the sale of consumer goods, the consumer has legal rights. Each item is subject to the legal warranty from the date of purchase by (where applicable, delivery to) the first owner. Any commercial guarantee does not affect these rights.

b. General

To invoke the warranty, the customer must be able to present proof of purchase.

For articles purchased online and delivered to the customer's home, the customer must contact Mknives BV customer service in advance, after which the customer must return the article to Mknives BV at his expense.

Any defect must be reported by the consumer within a period of 2 months after it has been established. Afterwards, any right to repair or replacement lapses.

The (commercial and / or legal) warranty never applies to defects that arise as a result of accidents, neglect, falls, abnormal or incorrect use, use of the article contrary to the purpose for which it was designed, non-compliance with the instructions for use or manual, modifications or changes to the item, rough use, poor maintenance, abnormal or incorrect use.

Nor does it apply to articles with a shorter lifespan, or wear articles.
Defects that manifest themselves after a period of 6 months following the date of purchase, if applicable, delivery, are deemed not to be hidden defects, unless proof to the contrary by the Customer.

The warranty is not transferable.

c. Force of the majority

Mknives BV is not responsible for the non-delivery or delivery of damaged products in case of force majeure.

Mknives BV reserves the right to refuse refunds in case of incorrect use of the purchased product.


Article 9: Right of withdrawal

The provisions of this article only apply to customers who purchase articles online in their capacity as consumers.
The consumer has the right to inform Mknives BV that he renounces the purchase, without payment of a fine and without giving any reason within 14 days from the day following the delivery of the product.
Customers who wish to make use of the right of withdrawal must contact Mknives BV customer service within 14 days from delivery and return the goods to Sparrenhof 13 3071 Erps-Kwerps at their expense within 20 days from delivery of the goods.

Goods with a sales price of 100 Euro or more must be returned to us by courier (DHL, Fedex, etc.).

The customer may not use the products during the withdrawal period. If the returned product is damaged or lost in value in any way, Mknives BV reserves the right to claim compensation for any decrease in value attributable to the customer.

Only items that are in the original packaging, together with all accessories, instructions for use and invoice or proof of purchase can be taken back.

Unless otherwise agreed, the customer cannot exercise the right of withdrawal for agreements:
1 ° regarding the provision of services, the performance of which, with the consent of the customer, commenced before the end of the withdrawal period;
